These General Terms and Conditions ("Terms") apply to all orders placed through peptidesdirect.io, operated by Toptimum Ltd ("we", "us", "the Company"). By placing an order, you agree to these Terms. We sell exclusively to customers who are at least 18 years of age. Your use of this website and any personal data you provide are subject to our Privacy Policy, available at peptidesdirect.io/legal/privacy. By placing an order, you acknowledge that you have read and understood our Privacy Policy.
Research Use Only
All products sold on this website are intended strictly for in-vitro laboratory and research purposes only. Products are NOT intended for human or animal consumption, therapeutic use, diagnostic purposes, or any in-vivo application. Specifically, products must NOT be used as or in: drugs, pharmaceuticals, or medicines; food or food additives; cosmetics or personal care products; medical devices; veterinary products; household chemicals; or any commercial product intended for consumption or bodily application. By purchasing, you represent and warrant that: (a) you are at least 18 years of age; (b) you have the legal capacity to enter into a binding contract; (c) you will use the products solely for legitimate in-vitro laboratory research; (d) you will comply with all applicable local, national, and EU regulations regarding the purchase, import, handling, storage, and use of research peptides; (e) you accept full responsibility for the proper handling, storage, and disposal of all products purchased; (f) you will not resell, redistribute, or make available the products for any prohibited use. You are solely responsible for ensuring that your purchase, import, possession, and use of products comply with all applicable laws and regulations in your jurisdiction, including import/export regulations, customs requirements, and any licensing requirements. We make no representation that products are legal for import or use in your jurisdiction. Reselling, repackaging, or redistribution of products without our prior written consent is prohibited. Any misuse of products is solely the responsibility of the buyer. By placing your order, you also confirm that you have sufficient expertise and experience in the safe handling of research chemicals.
Reconstitution and Handling
Several research peptides are sensitive to the pH and purity of the reconstitution water and can turn cloudy or fail to dissolve fully if reconstituted with unsuitable water (for example tap water, non-sterile water, or contaminated or expired bacteriostatic water) or with incorrect technique (for example shaking, wrong volume, or wrong water-to-peptide ratio). Reconstitution takes place at the customer's premises after delivery and is outside our control. Correct technique and the use of suitable, high-quality water are the customer's responsibility. We provide reconstitution guidance for orientation only; it does not replace the expertise expected of a research user under the 'Research use only' section. Because cloudiness caused by unsuitable reconstitution water is a matter of preparation and not a product defect, any replacement we provide for it is a goodwill gesture: we replace an affected product free of charge once, after which no further replacement or refund is owed for cloudiness, and the product must then be reconstituted with the customer's own suitable water of an appropriate pH. This clause does not limit your statutory rights in the case of goods that are defective, damaged, or not as described at the time of delivery.
Contract Formation
Product listings on our website constitute an invitation to make an offer, not a binding offer. By placing an order, you submit a binding offer to purchase. The contract is formed when we send you an order confirmation email. We reserve the right to decline any order.
Prices & Payment
All prices are listed in Euros (EUR) and include applicable taxes. Shipping costs are displayed separately during checkout. We accept payment via Visa and Mastercard (processed by MoneyEU / Loxworth International Limited / CircoFlows), SEPA bank transfer, and cryptocurrency (via NOWPayments). Credit and debit card payments are processed instantly. For SEPA transfers, the order is processed upon receipt of payment (typically 1-2 business days). For cryptocurrency payments, the order is processed upon blockchain confirmation. For payments via bank transfer (SEPA) or cryptocurrency, you will receive an invoice with the applicable payment term upon order confirmation. After the payment deadline, you will receive a payment reminder. If payment is still not received, formal dunning notices will be issued. From the 1st dunning notice, a fee of EUR 5.00 applies; from the 2nd dunning notice, EUR 10.00 plus late payment interest (2% p.a.). Card and cryptocurrency orders are automatically cancelled after 48 hours (2 days) without payment. SEPA bank transfers are granted 3 business days (Monday to Friday), as bank transfers are only settled on banking days. Payment processing is provided by third-party payment service providers. We are not responsible for any errors, delays, or failures caused by payment processors, including declined transactions, processing delays, currency conversion issues, or blockchain network congestion. Third-party payment processors are subject to their own terms of service and privacy policies. We reserve the right to contact you via the contact details (email and phone number) provided at checkout for matters related to order processing and payment, in particular through transactional email and SMS payment reminders when payments are not completed. This contact is based on Art. 6(1)(b) GDPR (performance of a contract) and is not marketing. Promotional SMS or email communication is sent only with your separate explicit consent. All prices may change at any time without prior notice. Price changes do not affect orders for which an order confirmation has already been sent.
Shipping & Delivery
We ship to all EU member states as well as selected European countries, including the UK, Norway and Iceland. Shipping costs are tiered by zone: Germany EUR 8.00 (free from EUR 150), other EU countries EUR 18.00 (free from EUR 200), non-EU countries EUR 20.00 (free from EUR 250), in each case per order. Estimated delivery time: Germany 1-2 business days, rest of the EU 2-4 business days, non-EU 4-8 business days. For non-EU countries, import duties and local taxes may apply. For business (B2B) orders, the risk of loss passes to you upon handover to the carrier; for consumers, the statutory passing-of-risk rules apply and the risk remains with us until the goods are delivered to you. International shipments may be inspected, delayed, withheld, seized or destroyed by customs or other authorities in the destination country. You are solely responsible for ensuring that the ordering, import and possession of our products are lawful in your country, and as importer you bear any import duties, taxes and clearance fees levied by the destination country. For business (B2B) orders, where a shipment is seized or destroyed by the authorities we will not reship and no refund will be issued. The mandatory statutory rights of consumers in the EU remain unaffected, including the right to redelivery or a refund if the goods are not delivered to you. By placing an order to a destination outside the EU, you confirm that, to the best of your knowledge, the import of these products is lawful where you are, and you accept that shipping there is at your own risk. We may cancel and refund an order prior to shipping if we have reason to believe that shipping would violate applicable law. Orders are shipped on the next business day after receipt of payment; we do not ship on weekends and public holidays.
Right of Withdrawal & Returns
Under EU Directive 2011/83/EU (Consumer Rights Directive), Article 16(e), the right of withdrawal does not apply to sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery. All our research peptide products are sealed for quality and safety. Once the seal is broken, the product cannot be returned. If you receive a sealed, undamaged product, you may return it within 14 days of receipt for a full refund, provided the seal is intact. Damaged or defective products will be replaced free of charge. Please contact us within 48 hours of delivery with photos of the damage. Once an order has been dispatched it can no longer be cancelled, and for unsealed research products all sales are final, as set out above. Your mandatory statutory consumer rights under EU law remain unaffected.
Limitation of Liability
Products are provided "as is" and "as available". To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that product descriptions, images, purity percentages, Certificates of Analysis, pricing, or other content on this website are complete, accurate, reliable, or error-free. Most Certificates of Analysis are supplied to us by our manufacturers and supply chain and issued by third-party laboratories (most commonly Janoshik); we do not independently verify these. Only specific batches, clearly marked as independent on our COA page, have been submitted by us for testing at an independent laboratory. We do not operate our own laboratory and give no warranty as to the accuracy of the certificates or as to the quality, purity, or identity of any product. Independent testing is rolled out gradually, batch by batch; at the time of your order, not every product has necessarily been independently tested by us. By placing your order, you acknowledge the scope of testing available at the time of that order; if that scope is not sufficient for a particular product, please do not order it. Minor variations in product appearance, packaging, or labelling may occur between batches. In the event of a pricing error, we reserve the right to cancel affected orders prior to shipment. Our liability is limited to the purchase price of the products ordered. We are not liable for any direct, indirect, incidental, special, or consequential damages arising from the use, handling, storage, or disposal of products, including but not limited to human or animal consumption. Product information is provided for reference only and does not constitute scientific or medical advice. By purchasing research products, you voluntarily assume all risks associated with the handling, storage, use, and disposal of such products. You acknowledge that research peptides may pose risks if improperly handled, and you accept full responsibility for following appropriate laboratory safety protocols. For consumers within the EU, statutory warranty rights under Directive (EU) 2019/771 remain unaffected.
Intellectual Property
All content on this website, including text, images, logos, and product descriptions, is the property of Toptimum Ltd and protected by copyright. Reproduction or distribution without written permission is prohibited.
Referral programme
Existing customers with an active account receive a personal referral code (format: REF-XXXXXX). The referred person receives a 10% discount on their first order, subject to a minimum order value of 100 EUR. After confirmation of the referral (14 days after shipment of the referred order) the referrer receives a single-use 10 EUR discount code by email, valid for 90 days. Self-referrals (same email or delivery address) are excluded. If the referred order is cancelled or refunded before confirmation, the referral becomes invalid; if the discount code has already been issued but not redeemed, it will be deactivated. We reserve the right to modify or discontinue the programme at any time and to revoke codes and suspend accounts in case of suspected abuse (multiple accounts, fraudulent orders, automated referrals). Discount codes are non-transferable, cannot be paid out in cash, and cannot be combined with other personalised promotions (except for the crypto payment discount).
Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paphos, Cyprus. For consumers within the EU, mandatory consumer protection laws of your country of residence remain applicable. In the event of a dispute, we encourage you to contact us first at support@peptidesdirect.io to seek an amicable resolution. Consumers residing in the EU have the right to submit complaints to an alternative dispute resolution (ADR) body. You may also contact the European Consumer Centre (ECC) in your country of residence for assistance with cross-border disputes.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes take effect upon publication on this website. Continued use of the website constitutes acceptance of the modified Terms.
Indemnification
By purchasing products from this website, you agree to indemnify, defend, and hold harmless Toptimum Ltd, its officers, directors, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use, handling, storage, or disposal of any products purchased; (b) any breach of these Terms by you; (c) your violation of any applicable law or regulation; (d) any third-party claims related to the products after delivery to you. This indemnification obligation survives termination of any agreement between you and us.
Force Majeure
Toptimum Ltd shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, government actions, sanctions, embargoes, customs delays, carrier disruptions, supply chain interruptions, internet or telecommunications outages, or any other event of force majeure. If a force majeure event continues for more than 30 days, either party may terminate the affected order(s) without liability.
Account Suspension & Termination
We reserve the right to suspend or terminate your account and refuse any current or future orders, without prior notice or liability, if we reasonably believe that: (a) you have violated these Terms; (b) you intend to use products for purposes other than legitimate in-vitro research; (c) you have provided false or misleading information; (d) your account is associated with fraudulent activity; or (e) continued service to you would expose us to legal or regulatory risk. Upon termination, any pending unpaid orders will be cancelled.
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed or modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, Disclaimer, and any order confirmation, constitute the entire agreement between you and Toptimum Ltd with respect to your use of this website and purchase of products, and supersede all prior or contemporaneous communications and proposals.
